About the Case

The client signed a Lump sum JCT 80 contract for the construction of a building in Mauritius.

The Challenge

The Client was faced with a falsified draft Final Account.

The Solution

The solution was to terminate the PQS with immediate effect.

The Contractor sued the Client and the matter went to the Privy Counsel and has been reported in the numerous journals. The decision went against the Employer as the judge relied on the Certificate of the QS as being tantamount to a Cheque which was due for payment. The challenge to the QS certificate came too late. The matter has been referred and action taken against the PQS who undertook the scope.
