The Contract was for 200 km of waste water network to a city location to connect residence to the main sewer network.
The Challenge
The client defended the non provision of an Serage Treatment Plant alleging the Contractor had yet to complete in full the existing works, ignoring the critical delay identified and who was the primary cause of the delay in the Project. The delay lasted for 4 years.
The Solution
Despite attempts at negotiation the Employer insisted every piece of work up to the house connection be completed prior to accepting the Contractor to demobilize. Irrespective of logic and additional costs of return visits and uneconomic working.
The Result
The matter ended in arbitration and AJB Consult successfully produced the Consolidated Claim, drafted the Statement of Claim and managed the process which resulted in the Contractor being successfully awarded full EOT with Prolongation costs.Case Info
